Living Wills

A living will is a document that allows you to determine how you want to be treated in certain medical situations.  Within a living will you can designate whether you want life-sustaining measures to be taken if you become incapacitated and unable to make your own medical decisions.  Some of these measures include CPR, being provided food and water, use of a respirator and blood transfusions.

Because a living will is not valid unless it follows the specific language found in Florida Statute 765.03, it is extremely important to have a skilled and knowledgeable attorney draft your living will.  Under Florida law, a living will can be used when a person is in a persistent vegetative state, suffering from a terminal condition, or an end stage condition.  The patient’s physician must decide whether the patient is unable to make their own medical decisions.
